Terms of Service

These Terms of Service ("Terms") govern your use of the Viddycom mobile application ("App") operated by Viddycom Ltd ("we", "us", or "our"), a company registered in the United Kingdom.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

Viddycom is a voice-controlled camera application that allows you to control your device's camera through voice commands. Using the App requires a free Viddycom account, created with Sign in with Apple, Google Sign-In, or an email address and password. Features include:

Voice-activated photo and video capture
Continuous listening, with an optional "Show Time" wake word
Face detection
Face tracking (auto-framing)
Natural language command processing
Timer and countdown functionality
Zoom control via voice

2. Subscription Terms

Important: Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

2.1 Pricing

Free Trial: 3-day free trial for new users with full access
Monthly Plan: $9.99 USD per month
Yearly Plan: $49.99 USD per year (save 58%)

2.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription in your Apple ID Account Settings at any time.

2.3 Free Trial

If you start a free trial and do not cancel before it ends, your subscription will begin automatically and your payment method will be charged. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

2.4 Founding Member Guarantee

Users who subscribe during our founding member period will lock in their subscription price for life, even if we raise prices or add premium features in the future.

2.5 Referral Program

Subscribers can share a personal referral link. These terms govern that programme.

Who can take part: anyone with a Viddycom account can share a referral link. You must have an active paid subscription at the time a free period is applied in order to receive one.
How credit is earned: you earn credit each time someone who signed up through your link pays for a subscription period — 1 credit for a monthly period and 12 credits for an annual one. Free trial periods earn nothing. We may reverse credit arising from a payment that is later refunded or charged back.
What credit is worth: credit has no cash value, cannot be exchanged for money, and cannot be sold or transferred to anyone else.
Getting your free period: when your balance reaches the threshold, we apply a free subscription period to your account automatically — there is nothing for you to claim. The current thresholds are 10 credits for one free month and 50 credits for one free year, and that number of credits is deducted from your balance. A free period is added to your future billing; it does not refund a payment you have already made.
If your subscription ends: unredeemed credit is held while your subscription is active. If your subscription lapses or is cancelled, any unredeemed credit may be forfeited.
Fair use: referrals must be genuine. Creating additional or fake accounts, referring yourself, buying or spamming sign-ups, or any other attempt to generate credit artificially will result in the credit being cancelled and may result in your account being suspended.
Changes: we may change the thresholds, the amount of credit earned, or any other part of this programme, and we may suspend or withdraw it entirely, at any time. Where a change materially reduces credit you have already earned, we will give reasonable notice and a reasonable opportunity to redeem it first.
Your statutory rights: nothing in this section affects your legal rights as a consumer.

3. User Content

You retain full ownership of all photos and videos captured using Viddycom. We do not claim any rights to your content. Your media files are stored locally on your device and are not uploaded to our servers.

4. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

4.1 Voice Data

Voice commands are processed using on-device speech recognition. When on-device processing is insufficient, text transcriptions (not audio) may be sent to cloud AI services for interpretation. Voice recordings are never stored.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer or decompile the App
Interfere with or disrupt the App's functionality
Use the App to create content that violates any applicable laws
Share your subscription credentials with others

6. Intellectual Property

Viddycom, including its design, features, code, and branding, is owned by Viddycom Ltd and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

7. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App settings. Upon account deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR SPECIFIC REQUIREMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIDDYCOM LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

10. Indemnification

You agree to indemnify and hold harmless Viddycom Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
